10/03/2009 New Weekly Infringement and Similar Publication Report

We have implemented a collective infringement and similar mark email once a week. This report will allow you to quickly view what trademarks need attention for the monitoring aspect of the service. After all, ¾ of our value is derived from our monitor service and your future work load is directly tied to the events. Expect these emails to come out on Wednesday, right after the publication list from the USPTO.

10/02/2009 New Email System

We are changing the way that you receive your emails. Our biggest priority has been the urgency of our email alerts to take action, to wit, we send out too many emails. So, moving forward we will send out one email a day that is a collective report of what is coming due. It will have the Trademark and Serial number still but will also include the owner of the trademark and some brief information about the action being responded to.

10/01/2009 MarkTend - Now in Public Launch!

We're really happy to announce to the universe that MarkTend is out of private beta and into public launch. We had an enormously successful private beta and would like to say a big “THANK YOU!” to everyone who contributed with bug reports, feedback, and ideas to help us make MarkTend even better. 9/22/2009 New Research section

We are currently incorporating a research section into the site that will be designed to hold GREAT replies to Office Action, Oppositions, Cancellations, and proceeding before the TTAB. This will allow you to quickly find if someone else has had your current problem and how they attacked.

9/20/2009 A whole boatload of new Features

In our run up for public launch we are bring you the latest and greatest at an increasing speed, hold on tight. . You will now find a TTAB tab (no pun intended) that will allow for the monitoring of a Cancellation or Opposition. We will then monitor the proceeding for changes and suspensions. Throughout the prosecution we will adjust the time points as necessary to reflect the changes.

The time points calendared are as follows:

  • Time to Answer
  • Deadline to Request Discovery Conference with Interlocutory Attorney Deadline for Discovery Conference
  • Discovery Opens
  • Initial Disclosures Due
  • Expert Disclosures Due
  • Discovery Closes
  • Plaintiff's Pretrial Disclosures
  • Plaintiff's 30-day Trial Period Ends
  • Defendant's Pretrial Disclosures
  • Defendant's 30-day Trial Period Ends
  • Plaintiff's Rebuttal Disclosures
  • Plaintiff's 15-day Rebuttal Period Ends

We also now have a function for setting time points on foreign trademarks. This section is a bit more traditional in that you have to set the time point in the system. As we find which countries our users are wanting to cover we will add in the automated function like the USPTO trademarks.

9/2/2009 New Extranet for your clients

In our effort to create value for your firm we have created a White Label program for our client extranet. Your clients now have access to most of the same data you have. The extranet is branded under your law firm for your clients, get them involved in their trademark protection too.

While MarkTend has been geared toward law firms we have been getting increased attention by larger corporations for our trademark docketing and monitoring system. We are now allowing corporations and businesses to use MarkTend. Welcome!

In our infringement searches we now include several large databases of common law sources.

4/11/2009 Plain language Next steps

Keeping the flow going, we have created a new plain language section on what next steps have to be completed on a particular trademark to bring it to registration.

4/07/2009 MarkTend adds new Abandonment alert system

We have created a new section that contains over due trademarks and a special alert system that deals with abandoned trademarks that need to be revived. Our other users are finding this section helpful in getting their trademark team on task.

4/04/2009 MarkTend reaches the 1,000 trademark level

3/24/2009 MarkTend launches TrademarkFly

MarkTend has created TrademarkFly as an alternative for micro Trademark holders. Trademark holders with fewer than 10 trademarks that are not associated with a law firm or have in-house counsel are encouraged to use TrademarkFly for our services. Most of the same features that are on MarkTend are also available on TrademarkFly.
